Welcome to Piotr Kulak Photography ("Photographer", "we", "our", or "us"). These Terms & Conditions govern your use of this website and any photography services provided by Piotr Kulak Photography. By accessing this website, contacting us, or booking a photography session, you agree to be bound by these Terms & Conditions.

1. Photography Services

Piotr Kulak Photography provides professional photography services, including but not limited to:

  • Portrait Photography

  • Fashion Photography

  • Editorial Photography

  • Commercial Photography

  • Personal Branding Photography

  • Lifestyle Photography

All services are subject to availability and may be modified without prior notice.

2. Booking

A photography session is considered confirmed once both parties have agreed to the session details and any required deposit has been received.

Until a booking is confirmed, dates and times remain available for other clients.

3. Pricing

All prices, packages, and promotions are subject to change without prior notice.

Any quotation provided is valid for thirty (30) days unless otherwise stated in writing.

4. Payments

Payment terms will be communicated prior to the photography session.

If a deposit is required, the booking will not be considered confirmed until the deposit has been received.

Failure to complete payment may result in cancellation of the booking.

5. Cancellations & Rescheduling

Clients are encouraged to provide as much notice as possible if they need to cancel or reschedule a session.

Rescheduling requests are subject to availability.

Deposits, if applicable, may be non-refundable unless otherwise agreed in writing.

In the event of severe weather, illness, or other circumstances beyond reasonable control, both parties will make reasonable efforts to reschedule the session.

6. Copyright & Image Usage

Unless otherwise agreed in writing, all photographs remain the exclusive intellectual property and copyright of Piotr Kulak Photography.

Clients receive a non-exclusive license for personal use of the delivered images.

Images may not be sold, altered, entered into contests, submitted for publication, or used commercially without prior written permission.

Commercial licenses are available upon request.

7. Creative Style

By booking a photography session with Piotr Kulak Photography, the client acknowledges that they are familiar with the photographer's portfolio, artistic style, and body of work.

The client understands and agrees that the final images will be edited in a manner consistent with the photographer's creative vision, artistic judgment, and professional standards.

Image selection, editing, retouching, color grading, cropping, composition, and overall artistic interpretation remain solely at the photographer's discretion.

While reasonable requests may be accommodated when discussed prior to the session, dissatisfaction based solely on artistic style, editing preferences, or subjective personal taste shall not constitute grounds for a refund.

8. Image Editing

All delivered photographs represent the photographer's final artistic product.

RAW files, unedited images, and editing project files are not included and will not be delivered unless specifically agreed in writing.

Additional retouching beyond the agreed package may incur additional fees.

9. Delivery

Estimated delivery times vary depending on the scope of the project.

Final images will be delivered electronically unless otherwise agreed.

While every effort is made to meet estimated delivery dates, they are not guaranteed.

10. Client Responsibilities

Clients are responsible for:

  • Arriving on time

  • Communicating special requests before the session

  • Obtaining any required permissions for chosen locations

  • Ensuring all participants arrive prepared for the session

The photographer shall not be responsible for missed photographs resulting from late arrival, failure to cooperate, or circumstances beyond reasonable control.

11. Website Content

All photographs, logos, text, graphics, designs, and other content displayed on this website are protected by United States copyright and intellectual property laws.

No content may be copied, reproduced, modified, distributed, or used without prior written permission.

12. Limitation of Liability

Every reasonable effort is made to provide high-quality photography services.

However, Piotr Kulak Photography shall not be liable for delays, cancellations, or failure to perform resulting from circumstances beyond reasonable control, including but not limited to:

  • Equipment malfunction

  • Severe weather

  • Natural disasters

  • Government restrictions

  • Power outages

  • Internet outages

  • Acts of God

  • Illness or emergencies

In all circumstances, liability shall be limited to the amount actually paid by the client for the affected photography services.

13. Privacy

Any personal information collected through this website, contact forms, Facebook Lead Ads, Instagram Lead Forms, email, or other communication channels is handled in accordance with our Privacy Policy.

By using this website or submitting your information, you acknowledge that you have read our Privacy Policy.

14. Third-Party Links

This website may contain links to third-party websites for your convenience.

We are not responsible for the content, security, or privacy practices of external websites.

15. Changes to These Terms

We reserve the right to modify these Terms & Conditions at any time without prior notice.
